Agency Agreement Attestation for Australia
Agency agreement attestation for Australia, for Indian companies appointing an Australian agent, distributor or reseller. Australia and India are both in the Apostille Convention, so when an Australian party asks for a legalised agreement, the answer is the MEA apostille after a notary and Chamber of Commerce. No Australian High Commission stamp is involved.

Agency agreement attestation for Australia: quick answer
Agency agreement attestation for Australia is an MEA apostille, when it is needed at all. Australia has been a party to the Hague Apostille Convention since 16 March 1995 and India since 14 July 2005, with no objection between them. An agency or distribution agreement signed in India is notarised, attested by a Chamber of Commerce and apostilled by the Ministry of External Affairs. The Australian High Commission does not legalise it.
Many agreements between private companies are used in Australia without any apostille, so first ask who wants it and why. If a court, registry, bank or buyer does ask, INFINITYGRO completes the Indian stages in Delhi and quotes in writing after seeing the agreement.
Does your Australian partner actually need an apostille?
Unlike Gulf countries, Australia does not usually ask for a commercial agency to be legalised before it can operate. Apostilles on agency agreements tend to be requested for a specific use. Ask your partner which of these applies.
Often asked for
- Filing the agreement as evidence in Australian court or tribunal proceedings
- A government or regulatory application that names you as the overseas principal
- A bank or financier wanting proof of the agency
- A large buyer or tender requiring a legalised authorisation
Usually not needed
- Day-to-day trading between you and your distributor
- Internal records of either company
- Sharing a signed copy with your Australian accountant
Stamp paper, signatures and supporting papers
An agreement executed in India is subject to Indian stamp duty under the stamp law of the state where it is signed. Your lawyer or company secretary decides whether it goes on stamp paper or an e-stamp certificate. The notary and chamber look at the signature and the document as a whole, so set this right before signing.
- Sign in ink; a printout of an e-signed PDF cannot be notarised as an original
- Put the company seal beside the Indian signature
- Use the signatory’s name exactly as in their passport or Aadhaar
- If the e-stamp certificate or any annex is in Hindi or another Indian language, ask whether your Australian partner needs an English translation of it
INFINITYGRO translates Indian-language pages into English, quoted by page.

High Commission, DFAT or MEA: which stamp?
MEA apostille
The stamp you need. It certifies the Indian document for use in Australia and other Convention countries.
DFAT apostille
Australia’s Department of Foreign Affairs and Trade apostilles Australian public documents. It states that each government can only legalise documents issued in its own country.
High Commission
The Australian High Commission in New Delhi is not part of the apostille route for an Indian agreement.
If your Australian partner also needs to send you something signed in Australia, for example their board approval, they arrange the DFAT apostille there.

FAQs: Agency Agreement Attestation for Australia
Does Australia accept an Indian apostille?
Yes. Australia has been a party to the Hague Apostille Convention since 1995 and India since 14 July 2005, and the HCCH status table shows no objection between them. An MEA apostille on your agency agreement is accepted in Australia without further legalisation.
My Australian distributor never asked for an apostille. Should I get one anyway?
Not unless someone needs it. Many private agreements are used in Australia without one. Get an apostille when a court, government body, bank or buyer asks, and keep their request in writing so the right document is prepared.
Can the Australian High Commission in New Delhi stamp the agreement instead?
That is not the route for an Indian agreement going to Australia. Because both countries are in the Apostille Convention, the MEA apostille is the recognised certification. We arrange it after the notary and Chamber of Commerce stages.
Does the agreement need translation for Australia?
Not if it is in English. Only pages in another language, such as a Hindi e-stamp certificate or a regional-language annex, might need an English translation, and only if the Australian side asks. INFINITYGRO can translate those pages.
We signed with DocuSign. Can that be apostilled?
A printout of an electronically signed PDF is not an original that a notary can attest. For an apostille, sign a paper original in ink. Check first whether the Australian side accepts the electronic version as it is; often it does for private use.
What if the agreement will be used in an Australian court?
Then follow your Australian lawyer’s instructions on the exact document, whether the original or a certified copy, and on the number of copies. Send us those instructions with the photos, and we will apostille exactly what they need.
How soon can the apostilled agreement be sent to Australia?
It depends on the chamber and the MEA centre, so we state the expected time in the written quote. There is no High Commission stage. Courier time within India and then to Australia is extra.
Can a New Zealand distributor use the same apostilled agreement?
New Zealand is also a party to the Apostille Convention, so an MEA apostille is generally accepted there too. If one agreement covers both countries, tell us at the start and we will confirm the position for each country in writing.
