Agency Agreement Attestation for Belgium

Agency agreement attestation for Belgium, for Indian exporters appointing a commercial agent or distributor in Antwerp, Brussels or elsewhere in Belgium. Belgium accepts the MEA apostille, so the agreement needs a notary, Chamber of Commerce attestation and the apostille, with no Belgian Embassy stage. The main question is which language your Belgian partner needs.

Quick answer

Agency agreement attestation for Belgium: quick answer

Agency agreement attestation for Belgium is done with an MEA apostille. Belgium has been a party to the Hague Apostille Convention since 1976. It objected to India’s accession in 2005, but withdrew that objection by a note dated 9 January 2008, according to the HCCH depositary records, so the apostille has applied between India and Belgium since then. The agreement is notarised, attested by a Chamber of Commerce and apostilled by the Ministry of External Affairs.

Belgium has three official languages, and the one your partner needs depends on where the agreement will be used. INFINITYGRO handles the Indian stages and translates into Dutch, French or German. The total is quoted in writing after we see the agreement.

Part 1 · Apostille status

Belgium and India: why the apostille works now

Belgium is one of the few countries whose apostille relationship with India had a gap. The HCCH records show the sequence clearly.

9 February 1976Convention enters into force for Belgium
14 July 2005Convention enters into force for India
20 April 2005Belgium notifies an objection to India’s accession, so the Convention does not apply between them
9 January 2008Belgium withdraws its objection with immediate effect

If you find older advice saying Belgium needs MEA attestation and Belgian Embassy legalisation for Indian documents, it dates from that gap. Today the MEA apostille is the route.

Part 2 · Language

Dutch, French or German: which one your partner needs

Belgium’s official languages are Dutch, French and German. The language a Belgian office works in generally follows the region, so ask your partner where the agreement will be filed or used.

01

Flanders, including Antwerp

Dutch is the working language of local offices.

02

Wallonia

French, with German in the small German-speaking community in the east.

03

Brussels

Both French and Dutch; your partner chooses.

A Belgian office may want a translation by a sworn translator in Belgium. INFINITYGRO translates into Dutch, French and German, quoted by page, and is useful for review before signing or where your partner accepts a translation from India. Ask your partner first.

Part 4 · EU context

Commercial agents in Belgium and the EU

Self-employed commercial agents in EU member states, Belgium included, are covered by national laws based on Council Directive 86/653/EEC. That directive deals with matters such as the agent’s commission, notice periods and compensation when the agency ends. These points matter when you draft the agreement, not when you apostille it.

  • Have a Belgian or EU lawyer review termination and compensation clauses
  • State whether the partner is a commercial agent or a buy-and-resell distributor
  • Define the territory: Belgium alone, Benelux or wider
  • Keep amendments as signed addenda so they can be apostilled if needed
INFINITYGRO does not draft agreements or advise on Belgian or EU law. We handle the notary, chamber and MEA apostille on the agreement you sign.

FAQs

FAQs: Agency Agreement Attestation for Belgium

Did Belgium once refuse Indian apostilles?

Yes. Belgium objected to India’s accession in April 2005, so the Convention did not apply between them. Belgium withdrew the objection by a note dated 9 January 2008, according to the HCCH records. Since then an MEA apostille has been accepted in Belgium.

Is legalisation by the Belgian Embassy in New Delhi still needed?

No. With the Convention in force between India and Belgium, the MEA apostille replaces embassy legalisation for an agency agreement. If a Belgian checklist still mentions an embassy stamp, send it to us and we will confirm the route in writing.

Our distributor is in Antwerp. Which language should the translation be in?

Usually Dutch, because Antwerp is in Flanders. Your distributor will know which office will receive the agreement and what it wants. If a sworn translation in Belgium is needed, they arrange it; we can translate for review or where a translation from India is accepted.

Can the agreement be signed in English only?

Yes. Many Belgian companies sign international agreements in English. The language question arises only when the agreement goes to a Belgian authority or court that works in Dutch, French or German. Ask your partner before deciding on a bilingual version.

Does the apostille make the agreement valid under Belgian law?

No. The apostille certifies the signature and seal of the Indian authority on the document. Whether the terms comply with Belgian and EU rules on commercial agents is a legal question for a Belgian lawyer.

Can one apostilled agreement cover the Netherlands and Luxembourg too?

The Netherlands and Luxembourg are also parties to the Apostille Convention. Whether India and each of them apply it to one another is checked in the HCCH table; send us the list of countries and we will confirm the position for each in writing before you sign.

How long before the agreement is ready to send to Belgium?

It depends on the chamber and the MEA centre, so we give the expected time in your written quote. There is no embassy stage. Add courier time from your city to Delhi and back, international courier to Belgium, and any translation you order.

Can you apostille a power of attorney for our Belgian representative?

Yes. A power of attorney signed in India follows the notary and MEA apostille route and can travel with the agreement. Ask your Belgian representative for the wording and language they need before you sign it.
