Agency Agreement Attestation for Argentina

Agency agreement attestation for Argentina, for Indian companies appointing an agent or distributor in Buenos Aires, Córdoba, Rosario or elsewhere. Argentina and India are both parties to the Apostille Convention, so the agreement needs a notary, Chamber of Commerce attestation and the MEA apostille. The Argentine Embassy does not need to legalise it.

Quick answer

Agency agreement attestation for Argentina: quick answer

Agency agreement attestation for Argentina is done with an MEA apostille. Argentina has been a party to the Hague Apostille Convention since 18 February 1988, and India since 14 July 2005; neither objected to the other, so the apostille has applied between them since India joined. An agency or distribution agreement signed in India is notarised, attested by a Chamber of Commerce and apostilled by the Ministry of External Affairs.

Argentine offices work in Spanish, so the agreement will usually need a Spanish translation in Argentina. INFINITYGRO handles the three Indian stages and can prepare a Spanish working translation. The total is quoted in writing after we see the agreement; there is no embassy fee on this route.

Part 1 · Apostille status

Why the Argentine Embassy stage is not needed

The HCCH status table shows Argentina’s accession entering into force on 18 February 1988 and India’s on 14 July 2005. When two countries are both parties and neither has objected, the apostille applies between them from the later date. So since July 2005 an MEA apostille has been enough for Indian documents going to Argentina.

What you need

Notary, Chamber of Commerce and MEA apostille, all arranged in Delhi.

What you do not need

MEA attestation followed by legalisation at the Embassy of Argentina in New Delhi. That route is for countries outside the Convention.

Part 2 · Spanish

Spanish translation and the public translator

In Argentina, documents in a foreign language are usually presented with a translation by a certified public translator (traductor público), whose signature is in turn certified by the translators’ professional body. Your Argentine partner or lawyer will confirm exactly what the receiving office wants.

01

Apostille first

The public translator translates the agreement together with its stamps, so the MEA apostille must already be on it.

02

Working translation

INFINITYGRO can translate the draft into Spanish before signing, so both sides read the same terms. It is not a substitute for a public translation in Argentina.

03

Bilingual option

A bilingual English and Spanish agreement is apostilled once. Ask your partner whether a public translation is still needed.

  • Currency and payment terms for commission or purchase prices
  • Governing law and dispute forum, reviewed by a lawyer

INFINITYGRO does not draft agency agreements or advise on Argentine law. We work on the agreement you and your partner have signed.

FAQs

FAQs: Agency Agreement Attestation for Argentina

Since when has the apostille worked between India and Argentina?

Since 14 July 2005, when the Convention entered into force for India. Argentina had joined in 1988. According to the HCCH status table neither country objected to the other, so an MEA apostille is accepted in Argentina without embassy legalisation.

Does the Embassy of Argentina in New Delhi need to stamp the agreement?

No. Embassy legalisation is for countries outside the Apostille Convention. For Argentina the MEA apostille replaces it. If your partner’s checklist mentions a consular stamp, send it to us and we will confirm the route in writing.

Who translates the agreement into Spanish?

Usually a certified public translator in Argentina, after the apostille is on. INFINITYGRO can provide a Spanish working translation before signing, so both sides agree the wording, but the Argentine office will normally want the public translation.

Is a bilingual agreement a good idea for Argentina?

It often helps, because both parties sign the same Spanish wording and the whole document is apostilled once. Ask your partner whether the receiving office will still need a public translation of the English part before you rely on the bilingual text alone.

Can we apostille an agreement signed with a digital signature?

Not as a printout. The notary, chamber and MEA work on a paper document signed in ink. If the agreement was signed electronically, sign a paper original for the apostille, or ask your partner how the Argentine office treats electronic documents.

Our Argentine partner signed first in Buenos Aires. Is that a problem?

No. The Indian stages cover your company’s signature. Your partner can sign first and courier the original to you. Make sure both signatures and seals are on the same original before it comes to us.

How much time should we allow before the agreement is usable in Argentina?

The Indian stages depend on the chamber and the MEA centre, so we state the expected time in your written quote. Add courier time to and from Delhi, international courier to Argentina, and time there for the public translation and its certification.

Can you also apostille a power of attorney for our Argentine lawyer?

Yes. A power of attorney signed in India follows its own notary and MEA route and can go in the same courier as the agreement. Ask your lawyer in Argentina for the wording they need before you sign it.
